    Since the 1990’s, California’s Housing Accountability Act (HAA) has provided what is called a ‘Builder’s Remedy’ tool within the law which allows housing developers to bypass the local zoning in cities that are out of compliance with the State’s Housing Element law. The State Legislature has recently strengthened these Housing Element Laws, which has created a more challenging environment for cities to achieve compliance. Now, approximately 106 cities across California are out of compliance. Enter the Builder’s Remedy.

     Even though it’s been on the books for 30 plus years, the Builders Remedy has never truly been tested until now. Developers across California are increasingly turning to this option as a means of facilitating project approval - but has it been effective? What have we learned works and what does not work? How do we think this will be tested in court and what might be the outcomes?

     Come hear from the developers and the land use attorneys working on Builder’s Remedy projects throughout the Los Angeles region. During the panel discussion, our esteemed panelists will explore the challenges and limitations of the Builder’s Remedy, and offer insights into on how it can be used to advance development projects through the entitlements process. The panelists will also share perspectives on the business case for pursuing a Builder’s Remedy project in the first place, drawing upon their own projects as examples.
